      Limits of Liability


      • •For causes of loss established by Missouri law, MOPERM's maximum limit of liability will not exceed the sovereign immunity limits provided by RSMo. Section 537.610. The causes of loss established by Missouri law are (a) injuries directly resulting from the negligent acts or omissions by public employees arising out of the operation of motorized vehicles within the course of their employment; and (b) known dangerous condition of property for which the entity is legally liable. The maximum limit is regardless of the number of covered parties under the Memorandum, the persons or organizations who sustain injury or damage, or claims made or suits brought. The sovereign immunity limits increase annually effective January 1st (see RSMo 537.610.5). The sovereign immunity limit of liability MOPERM will pay for causes of loss established by Missouri law.
      • •For causes of loss other than those established by Missouri law, and for public officers and employees, the maximum limit of liability is $2,000,000 for any one occurrence arising out of Bodily Injury, Property Damage, Public Officials Errors and Omissions, or Personal Injury, or any combination thereof. The $2,000,000 maximum limit is regardless of the number of covered parties under the Memorandum, the persons or organizations who sustain injury or damage, or claims made or suits brought.
      • •Aggregate limits do not apply to MOPERM coverages.


        • Any Public entity that discontinues participation in the pool is ineligible to participate for a period of 3 years from the date it discontinued participation. 537.705(3), RSMO
