Liability Coverages


Submissions

  1. Applications for new business will be accepted no more than 120 days prior to proposed inception date.
  2. The first received and most complete application shall be quoted. The MOPERM application will be considered most complete in all situations.
  3. Supplemental documentation that must be received with an application in order to consider a submission complete includes 5 years' currently valued loss history (currently valued within 90 days) for all lines of coverage to be quoted, an itemized annual budget that reflects actual figures for the most recent complete fiscal year, and when applicable, complete schedules of automobiles to be quoted (make, model, VIN# and cost new).
  4. Incomplete and/or generic applications may be returned for completing or clarifying, or underwriting staff may request additional information via telephone.
  5. Re-submissions will only be accepted after a nine(9) month waiting period from the rejection of a quotation provided.


Quotations

  1. Quotes will be valid for 45 days unless specifically waived by the Underwriting Manager.
  2. The quote format will specify coverages, deductibles, and annual contributions quoted. Limits, optional coverages, and coverage placement requirements will be noted in quote format. Officials should always review quotes for conditions and accuracy.
  3. All MOPERM accounts have a common expiration date of January 1st. A quotation can be expected within 30 days of MOPERM receiving the entire required information. However, during the renewal period (Oct. 1—Jan. 15) increased time restrictions may be placed on new business quotes.
  4. Property coverage may be placed with MOPERM as a mono-line (stand alone) line of coverage.


Required Lines of Coverage

  1. Automobile coverages may be placed with MOPERM as a monoline (stand alone) line of coverage.
  2. Law Enforcement Liability, Public Officials Errors & Omissions, General Liability, Medical Malpractice and Employment Practice Liability coverages must be placed together.
  3. Coverage may be placed with MOPERM at any time.


Limits of Liability

  1. For causes of loss established by Missouri law, MOPERM's maximum limit of liability will not exceed the sovereign immunity limits provided by RSMo. Section 537.610. The causes of loss established by Missouri law are (a) injuries directly resulting from the negligent acts or omissions by public employees arising out of the operation of motorized vehicles within the course of their employment; and (b) known dangerous condition of property for which the entity is legally liable. The maximum limit is regardless of the number of covered parties under the Memorandum, the persons or organizations who sustain injury or damage, or claims made or suits brought. The sovereign immunity limits increase annually effective January 1st (see RSMo 537.610.5). The sovereign immunity limit of liability MOPERM will pay for causes of loss established by Missouri law.
  2. For causes of loss other than those established by Missouri law, and for public officers and employees, the maximum limit of liability is $2,000,000 for any one occurrence arising out of Bodily Injury, Property Damage, Public Officials Errors and Omissions, or Personal Injury, or any combination thereof. The $2,000,000 maximum limit is regardless of the number of covered parties under the Memorandum, the persons or organizations who sustain injury or damage, or claims made or suits brought.
  3. Aggregate limits do not apply to MOPERM coverages.
  4. All MOPERM coverages are occurrence form.


Deductible Options

  1. An entity may select a $500, $1,000, $5,000 or $10,000 deductible as an option.
  2. Mandatory deductibles may be required, which could include loss and loss adjustment expense, for an entity's specific exposures and/or loss experience.
  3. Self Insured Retentions (SIR) are available for $25,000, $50,000 or $100,000. SIRs do not apply to legal expense unless otherwise required.

  4. Employee Benefits Liability has a mandatory deductible of $1,000.
  5. Deductibles available for automobile physical damage are the same as industry standards with the minimum being $100.




Special Coverage Notes

  1. MOPERM coverage is first dollar, and defense cost is in addition to policy limits.
  2. Employee Benefits Liability Endorsement with a $1,000 Mandatory Deductible is an optional coverage under the General Liability for an additional charge.
  3. Public Officials Errors and Omissions includes breaches of duty arising from negligent action, inaction, mistake, misstatement, error, neglect, inadvertent or omission in the discharge of duties.
  4. Due Process Coverage Extension Endorsement (I.E.P.) with a $25,000 limit and $2,500 deductible is an optional coverage under Public Officials Errors and Omissions for an additional charge.
  5. Any Law Enforcement officer with arrest authority must be P.O.S.T. licensed in order for coverage to extend to the individual officer. Moonlighting is excluded.
  6. MOPERM automobile coverage may include hired and non-owned liability, fleet automatic, and/or agreed amounts.
  7. Employment Practice Liability extends coverage to hiring and firing actions, discrimination and sexual harassment.
  8. Prior Acts/Retroactive Tail coverage may be quoted.
  9. Any public entity that discontinues its participation in the fund is ineligible to participate for a period of three (3) years from the date it discontinued participation. 537.705(3), RSMo.
